Working and Cancer

I had my lumpectomy surgery in August this year and I still have not gone back to work. My breast surgeon has signed me off until 6th Dec and I feel a bit of a fraud. I am still waiting for my radiotherapy schedule as I have had my planning CT Scan

The pain has actually now gone although i do have a bit of fluid retention in my breast. 

My HR manager is coming to see me at home in the next couple of weeks as they are going to put me on SSP. I am really going to struggle on the reduced salary coming into the house, as I live on my own.

Would it be a good idea to ask my GP to shorten my sick leave?

Struggling with this as I dont know what to do for the best

  • Hi Lesley,

    Have you contacted Macmillan? They can give advice on the best way forward for you. It is possible that you may be entitled to other benefits , which might help to top up your SSP.

  • Making you redundant is harsh and very unfair. Was your redundancy due to your ill health? Obviously I’m unaware of your age and type of employment but is there a possibility of appealing that decision and taking early retirement through ill health? MacMillan are very good with advice about any possible benefits you could be eligible for. 

  • If they have made you redundant you will have been treated, by the looks of it, unfairly as when you have cancer you are protected under the Equality Act as a person with a disability and this is from day one of starting work. If you are not in a union, go see citizens advice or ring ACAS and get yourself taking them to an employment tribunal for discrimination and unfair dismissal; you will win and it won't cost you. You have 3 months minus one day to put in a claim, so best contact ACAS first

  • Unfair dismissal under Equality Act 2010 legislation. Ring ACAS. It's free service, they will help you make a claim for unfair dismissal. You have 3 months minus one day from day you were sacked to put in claim. You will win.
