Employer has requested a meeting whilst I'm off sick

Hi 

I've been off work on sick leave from the day of my surgery for breast cancer on 13th April. My recovery from it had been slow and now my oncologist has signed me off til mid July.

I have kept my line manager updated both prior and since being off and when I advised that I will be off a further 2 months at least they have now asked for a 'case conference meeting' with HR present. 

In the letter it has about 10 bullet points of things to be addressed in the meeting. This includes a questiin about when i might be ready to return, reasonable adjustments, and possible outcomes.

Work has been good with no pressure til now but this kind of formal meeting has made me a little nervous. I know I'm covered by the Equality act 2010 but I'm not sure in terms of what questions they can/can't ask and whether I can refuse to answer any (ie I can't predict when I'm going to be well enough to return to work as I have to have radiotherapy too and my oncologist has said that as I'm already experiencing fatigue I am likely to have this exacerbated). I've also got  to have physio to improve my arm and shoulder movements prior to the radiotherapy.

I am interested to know if anyone can answer any or all of these questions. Thanks in advance.

    I've been offline all weekend, so have only just seen this thread. I was going to suggest talking to MacMillan but you've already done that.

    If you're not in a Union, your HR rules may allow you to take a friend in with you to act as an advocate. It might be handy to have someone there to speak for you if you are lost for words - these meetings can be quite stressful. 

    One of the questions I always asked when chairing similar meetings was "what do you want to get out of this meeting?" so be prepared for that one.

    In my own meetings following my diagnosis, I went from wanting to return to work as soon as I was able to through to wanting to take early retirement as soon as possible.

    Hope your recovery is going as well as can be expected.

    Myself and my partner have a business employing 14 members of staff, unless you are of work for stress, depression etc they can call you in for a meeting as they have a duty of care towards you. 

    It will more than likely be a tick box excercise to see if they can offer you support, however I would highly recommend that you take someone with you to act as a witness. This can be either a colleague or friend. Unfortunately some businesses do not play by the rules so you need someone with you as an extra pair of ears.

    just picked up this thread.  How did your meeting go?

    if you have any specific questions or concerns pm me. My daughter works in HR for a large company. She is a people person and a very sympathetic sort.  She will be on your side I know. She may be able to give the info from the employers  perspective that may help you.

  • Hiya sundial. It actually went well. Instead of doing it as a formal stage of our sickness disciplinary the did it as a case conference. He tolkd my manager that they will not request any more meetings for 3months. The are also referring me to occ health so they  can get all necessary adjustments in place before I return to work. This will include things like phased return, equipment, breaks from the computer to rest my arm and reduced monthly performance targets. So all in all it was a good meeting. 

  • That sounds great. From what my daughter tells at most of these meetings, HR are on your side, that’s their job. They have a duty of care to make sure that things are right when you return to work. She always enjoyed this part when she could help people. She works in communication and worker engagement now because she hated the disciplinary aspect of her previous job. Don’t forget though, if you have anything specific, I will ask her and I’m sure she will help if she can.

    You dont have to answer anything that you are not comfortable answering, if you are concerned about the questioning then refuse the meeting until you have a legal representative or either let them know that you will be recording the meeting for notes.
