Medical Negligence

Hello

Does anyone have experience of contacting a solicitor regarding medical negligence?

 In March 2023 I was hit by a hard dig ball whilst out running and put up with discomfort for a month before going to my GP in April 2023. GP referred me to breast clinic where I was examined but NOT offered a mammogram or scan and told the pain was bruising.

July 2023 I went back to GP again as pain was still present and told nothing sinister after breast examination and told to take painkillers and that the bruising would take up to a year to heal. Back to GP again March 2024 as pain still present and was referred again to breast clinic.

April 2024 had mammogram, scan and core needle biopsy. Ten days late I was told I had Stage II Grade III HER2 positive breast cancer. I was horrified that a whole year was wasted after three professionals told me there was nothing to worry about and no images had been taken.

A friend of mine who is a retired nurse thinks I may have a cause for medical negligence.

Has anyone experience of this?

    I'm sorry to hear about all that you've been through since you first had concerns about your breast health. It sounds like it's been a difficult time for you.

  • Hi Sandradee,  I don't think that you will have a case.  I approached one of these no win no fee companies and they refused it.  I had breast cancer 12 years ago and had lumpectomy, chemo and radiotherapy and then tamoxifen/letrazole for five years.  In March 2024 I went to the doctor for pain in hips and back.  She sent me for an X ray.  Never heard back from doctor.  Looked on NHS app.  It stated 2 sclerotic bone lesions in hip not the cause of pain probably arthritis.  Still not heard anything from doctor.  I phoned doctor who said that he was certain that there was nothing to worry about.  I insisted I was not happy, he referred me to physio.  Had two sessions and then physio decided to refer me for MRI.  Had MRI in August.  Had a telephone call from doctor to say they had found bone metastases.  So after many scans etc I now have metastatic breast cancer with mets in most of my bone.  Started treatment in December 9 months after going to doctor.  This is now treatable not curable.  I would be very interested in hearing how you get on.  The company told me they would not take me on with a no win no fee but I could pay. 

  • Thank you for your reply and I am so sorry to hear the cancer has returned. I am going to look at a solicitor with a no win no fee  policy and chat with citizen advice.

    Best wishes with your treatment. What will that consist of? I am always aware that cancer is sitting on my shoulder ready to strike again but I am trying to get on with my life. For you to go twelve years free only for cancer to return in your bones is heartbreaking. Hope do you cope?

  • Hi Sandradee  I am okay receiving palliative treatment.  I just get on with everyday things and try and enjoy each day.  I am still fit and healthy enough to walk my dogs, shop, eat out go to pubs etc.  I am living with cancer and tend to enjoy my life.  Hoping to go to Portugal in September.  Please let me know how you get on because I might approach another company to see if they think I would be successful.  Are  you having chemo at the moment?  I hope all goes well with your treatment and recovery.
