Work And Cancer

Since having  a Thymona 3  years ago I have been in and out of jobs not out of choice but dismissed  because of my illness. You tell the company that you have a disability so you can have reasonable adjustment to go to the hospital bearing in mind you are afforded protection under a characteristic of the Equality Act 2010 due to your disability . Unfortunately companies wiggle out of this at all costs the best one todate for me was that  i was accused of misleading a company for not being honest about my cancer they sacked me for a betrayal of trust. joke i know. When i joined the company I told  their Occupational Health  i was in remission 3 years  from a Thymona stage 2 B2 Invasive  and had been treated like any other cancer patient i had been completely honest i was awarded protection like all of us under the Equality Act 2010 under a protective characteristic, remember that, good bit of legislation.It states in that legislation that reasonable adjustment will be made to keep someone with a disability in employment Cancer is a disability people. However this legislation did n't help me the company still terminated my contract as they said i misled them. They terminated my contract for health and safety risk due to having lung Cancer "Serious" now i have never been diagnosed with this and in my probationay meeting i protested  but it didn't stop a pompous Manager with no medical training to come to that decision to terminate my employment. Serious Breach of the Equality Act 2010, Aint life Sweet! Cancer can be hard to come to terms with and we all soldier on but what doesn't help is idiots in companies that don''t know the law. so i imagine your all with me by saying shame on them! ironically the government set legislation to protect us, yes you guessed it i worked for a company run by the government. A warning to all watch yourselves don't trust no one only close family and friends. If anyone else has been down the same road as me drop me a line because companies should not be getting away with this.

    Well shame on them... they should hang their heads, it's disgusting. . I know Dave on here knows a few rules too about employment law ... if I were you I'd take it to an unfare dismissal tribunal ... not sure how .. but it sounds like you got a strong case .. even if it is government run .. remember David and goliath ..

  • Just to add to what Chriss says, you are covered by the DDA, so yes your former employers are breaking the law.

    thanks for the reply we all need to stick together I am going to fight this decision, enoughs enoughs fed up with being pushed around. Companies think they are above the law, and yes Wolfe Smith Robert Lindsay Friday night comedy and it was called citizen Smith. Power to the people! Sitting on a lion in London square  just that comment cheered me up and put a fire in my belly. My wife said remember who you are  ex Grenadier Guard, once a Grenadier always a Grenadier fight for it so watch this space

    Sorry (but not surprised) to hear about the hassle you've been getting from employers - the World seems to be full of idiots.

    If you're not in a Union (unlikely until you're in a job) and want to fight this you could Google "no win no fee employment discrimination" and go down that route. Citizen's Advice and MacMillan might be able to advise too.

    Trust no-one is always good advice :-)

  • Thanks Dave,wheels are in motion making a stand no matter what these imbeciles in companies can not get away with this obnoxious behaviour. Trust no one suspect everyone that’s the motto today.

    just an update about work got some sound advice from McMillan law works they have helped immensely certainly shaken the tree making a stand. So will keep you updated it’s about time these companies realised that they can’t behaviour like morons. We are survivors who go the extra mile an asset to any company Shame  on them it’s there loss. Keep smiling laughter is the best medicine

    Just thought I give a update got my appeal tomorrow to get my job back. Not sure how it will go but I am up for a fight the lads are thinking of coming out on strike in support not sure how the EA will cope with that. THey say don’t mess with best the best don’t mess. Whatever happens I am making a stand fed with imbecile in companies turning cancer club members over. We have rights! I am not the only one out there that’s been turned over by companies.
