Time off work to take a holiday with terminally ill spouse

I work in a shop two days a week. I have applied for two days holiday between Christmas and new year. I have been told I cannot take one of those two days although I am owed the holiday and it is the last day I can take it. My husband is terminally ill and we have school and Uni age children so holidays must fit in with term time and all through a rather gruelling six months of chemo we were unable to have any kind of family break. I am really struggling mentally as I am still in the process of having reconstruction treatment post breast cancer myself. In short I believe if I don't have this time off to spend together doing nice things we may miss the last chance. I am also worried my company wants rid of me because of all the operations I've had to have requiring sick leave, then now this with my lovely husband. How can I politely and legally make sure I get the holiday I am entitled to without risking my job? I have asked all team members to swap with me but no one is willing.

  • Hi Ness9

I'm.so sorry to read the predicament you find yourself in and can only imagine the added distress this is causing you and your family.

Your work cannot get rid of you the law changed in 2010 I think so the employee is protected if diagnosed with cancer. Your best thing is to call Macmillan about work though as they will be able to help.

I'm not sure how it stands with them giving you that exact date off as long as they give you the holiday before time is up they have fulfilled obligation. Know that doesnt help neither that there isn't someone you can swap with. I expect people are finding that hard because of last Christmas.

Hoping you can find a solution for all the family.
