Return to work

Had an absence review with my work last week after they referred me to occupational health in October.

Was diagnosed with breast cancer in May, had a partial mastectomy in June followed by radiotherapy. Also have long term ME and suffered a major flare up of this at the start of the year which lasted till May. Been suffering from severe fatigue since finishing my course of radiotherapy.

Occupational health suggested a further four weeks off followed by an 8 ~ 12 week phased return. My doctor signed me off for six weeks and says we can discuss a return to work then.

At the absence review my work says they will not support such a long phased return as I have only had a partial mastectomy and not a full one!!! Basically they can't understand why I'm not back at work already and made me feel like I was lying when I explained that I ws still exhausted and didn't feel I was anywhere near ready to return

Has any one else been in this situation?

Thanks

Alex

  • Hi there ..

Firstly ask them to check the guidelines from government... they have to abide by those guidelines on cancer and return to work .. things have changed ..

Also ask them to find out about radiotherapy... download side effects of radiotherapy... plus you've got M E ...  and if your Dr is supporting you .. don't think they can over ride him / her ...

I'm asking [@davek]‍  to pop on, as he can give you the information on where to find those work after cancer rules ...  I recon your bosses are lucky enough not to have been touched by cancer , and I had a total right masectomy,  but I know partial masectomy can take even longer to get back to normal ..

Let us know how you go ...   Chrissie x

  • Hi Alex,

if you are in a union, get in touch with your rep as they can be great in supporting discrimination cases, which is what this is. The law calls for employers to make reasonable adjustments for staff with disabilities and, whether your employers like it or not, cancer is classed as a disability so far a equal rights are concerned - even if you had cancer in the past and don’t have it now!

MacMillan are pretty good in this area - see www.macmillan.org.uk/.../discrimination.html

    Good luck

    Dave

  • Not a member of the union but I am seeking advice from the Beaton specialist health and work services who may be able to attend any future meetings with me.
