Brain tumour/injuries and stroke and sex and uk consent law

Hello. I am struggling to get some answers so hoping you can help me. I am wondering how the law sits with brain injuries/tumours/stroke and sexual activity. It seems to imply it could be seen as rape if something went wrong as not able to fully understand consent like with under a certain age. Especially if in certain types of tumour or brain as language understanding affected more. Does anyone have any info on this? It seems a fluffy ruling at best and even thinking of someone else in the situation and protecting them would to me show care and understanding and know effects of pregnancy stds and saying no if you want to. I’ve flagged it on other forums and they think it could be rape if take part but still not clear so asking here. Thank you hoping I can get some clearer understanding. Happy New Year and thanks for helping x

  • Is there a legal team we could get any definitive answers on for this?
